Website Content
The contents of this website and the website as a whole, are intended solely for personal, non-commercial use by the users of this website. You may not reproduce, publish, transmit, distribute, display, modify, create derivative works from, sell or participate in or exploit in any way, in whole or in part, any of the contents, the website, or any related software.
Privacy
We respect your privacy and do not and will not give away or sell any of the information you provide when using this website or our services.
When you place an order through the ‘shop’ area of this website, we ask for your name, email address, phone number, billing address, shipping address and payment information. we will use this information to fulfil your order and to communicate with you about it – that’s it. In order to receive information about shop updates, such as new product releases, sales etc, you must subscribe separately to our newsletter.
Unless required by law, we will and do not share your personal data with any third parties outside our business and you have the right at any time to request what personal information we hold, request corrections to errors in your personal information or request the deletion of your personal information. We will always do everything within our ability to uphold your rights and requests regarding your personal information.
Except for cookies, personal information collected may be stored indefinitely or until you ask us to delete it. Basic financial transaction information must be stored for seven years to comply with local tax laws.
This privacy policy may change without notice. Rest assured our principles of respecting your privacy are unlikely to change.

Comments
When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.
An anonymised string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.
Media
If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.
Cookies
If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

How long we retain your data

No Commercial Use
You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, display, reproduce or perform, or in any way exploit in any format whatsoever the site, the products and/or services or the content, our Intellectual property and third-party licensed intellectual property in whole or in part without our prior written consent. we reserve the right to immediately remove your access to our site, products and services, content, without refund, if you are found to be violating these terms.
Free or Paid Content
Where you download or purchase our digital products (including checklists, guides, ebooks, workbooks, video or audio content) (digital products) you are granted a non-exclusive, non-transferable, limited licence to access and use the digital products for your own personal use. You may not assign or transfer the digital products to any other person without our express written consent. We reserve the right, in our sole discretion, to accept or refuse to provide the products or services to you at any time for any reason.

Art Licensing Catalogues
The art licensing catalogues provided by Moko-ia Creative licensing agents and their contents are solely for the use of authorised potential licensing partners and clients. You will need to contact their agents directly in order to gain access to them. In the first instance email contact@mokoiacreative.co.nz
You do not have permission to share your password or url link to licensing catalogues with any third parties. In doing so you will be in breach of the terms and conditions of this website, which will result in the banning of your access and possible legal action.
Copyright
Please note that as the original artists, Moko-ia Creative retains full copyright to all of their artwork and derivatives, including custom designs and products that they produce.
Please be aware that a client’s creative input does not equate to copyright ownership. nor does licensing an artwork mean that you have copyrights to the artwork. If you wish to buy the copyright to an artwork, you will need to contact Moko-ia Creative directly and request a full copyright buyout.
While using Moko-ia Creative designs as ‘inspiration’ to inform your designs may not directly breach copyright, it does have a host of ethical and moral issues. If Moko-ia Creative work informs your own and you then monetise it, we would ask to receive a percentage from sales. If recompense is not made this may impact your authenticity and credibility as an artist.
Artistic Style
Moko-ia Creative has worked with pono integrity and tikanga correct protocols for many years to develop strong signature styles. This means that Moko-ia Creative may use similar elements, motifs and colour palettes across a range of different designs. Moko-ia Creative therefore reserves the right to create designs of a similar nature, in their signature style, for licensed and custom artwork.
Warranties and Disclaimers
This site is provided on an “as is” and “as available” basis and to the fullest extent permitted by law we make no representations or warranties about this site or the products or services including that:
- they are suitable, reliable, complete, secure, accurate or fit for any particular purpose;
b. access will be free of any harmful components (including viruses) or other code that is harmful or may assist in causing harm; or
c. there is no possibility of failure to store communications or other data.

In terms of GDPR, Beaver Builder products do not collect any personal information from your users. However some modules such as videos and maps might need you to update your privacy policy accordingly.
